slazer2au, do games w EA loses minor FIFA loot box legal case in Austria

The order comes from Landesgericht für Zivilrechtssachen Wien, which is a regional court in Vienna. The court ruled that these loot boxes violate gambling laws. However, this is a standalone decision, and has no wider impact on the country’s legal position on loot boxes.

In Austria, civil cases are taken on a case-by-case basis, and the courts are not bound by previous decisions.

So nothing will come of this.

Loot boxes are loot boxes… as long as you don’t know what you’re getting then it’s literally a gamble.

I’m hoping one day this stuff gets banned worldwide.

Wouldn’t that make McDonald’s happy meals also gambling? If not explain the franchises that will absolutely refuse to swap toys during certain promotions (Bionics and TY I can think of off the top of my head).

Naminreb,

I don’t think people buy happy meals for the toys. You know what you’re getting to eat, which is the purpose of the chain. It is a food service company, not a toy manufacturing company and the toys are only tokens of appreciation for the customer.

EA is a video game company and your experience and ability to play the game basically depends on these loot boxes. In fact, you play or pay to increase the chances to get a good deck, but nothing is guaranteed. It is random or perhaps even more perverse, it is programmed to deny or condition good players on your decks to keep you playing for the next loot box.

The only way this is not gambling, is that you don’t win money at the end of the day. Just satisfaction.

Aren’t they just skins and hats and cosmetics though? Unless it actually impacts the game play I don’t really see the difference.

Astronautical,

Fifa loot boxes contain different players, so you could either get Messi or a 3rd grade soccer player, with the 3rd grader being weighted more heavily in terms of being acquired.

  • Rynelan,

Those cards still hold value and the game is made to be played with multiple of the same cards. But you’re right, trading cards are a gamble.

You pay for a mystery pack

You either get good or bad cards

You’ll keep buying to get better stuff

    It has all the checks.

But I think it’s important you don’t need to buy booster packs to enjoy the game. I can buy multiple pre-made decks and I know exactly what I get and still can enjoy the game.

Some games (now not talking about FIFA) even rely on loot boxes to make the game more enjoyable. You even can get timed stuff you can only use an X amount of days and poof… it’s gone.

Also digital purchases might be considered “too easy”. With cards you at least get something physical.

Not sure though… all I personally think is that micro transactions and loot boxes are killing the fun and quality of games.

When I was a kid, I’ve asked for a specific toy before. I think you can, or could, even buy them separately without purchasing a meal.

Do we know how much they made with this loot box system in Austria? I can see just one Austrian whale paying more than the ordered €10,800 on loot boxes. I don’t see EA stopping if they’re still making a profit on these in the big picture, if they’re only losing some legal battles and being ordered to pay less than they made.

It’s not really an indie game is it? large team, big money, subsidiary of a big publisher

    forgotaboutlaye,

Yeah I kinda thought Battlebit Remastered would be the Unity, Early Access, Indie hit of 2023.

Meh. The game had horrible performance for a pixel art 2d game.

I’ve been watching a few streamers play this game, and the pixel art animations are honestly amazing. Every time a new cut scene is triggered it’s just delightful to watch.

    NuPNuA,

I think they’ve justifiably earned some of the ire aimed at them. Kotaku that is, not women.

That’s a bummer. I really liked the vision she initially set out with when she entered the role, but the actual content of the site never seemed to move beyond “game journalism, but a bit more snarky.” I wonder if some higher-ups never really let her vision move forward.

    pulaskiwasright,

Gaming and tech “journalism” would benefit so much from reducing the snark over their currently obnoxious levels.

Spending too much time with games or internet either implies serious problems the person is trying to escape from, or a lack of alternative activities. Trying to force the people to stop won’t do anything, the goal should be to make it so people don’t feel the need to rely on these two as much.

If someone is bored they will just move to the next most dopaminergic activity, I would know I stopped playing all games one year at university and all I managed to do is read a bunch of books namely 2000 chapter Chinese xianxia novels. Me deciding to purely grind schoolwork was the thing that actually had any impact.

Nobody seems to be saying this, but a 16yo playing 2hrs or more any day is ok and their choice. Making anyone under 18 only allowed to play 1hr a week is overly controlling and uncompromising - much like the rest of China’s policies.

    sugar_in_your_tea,

Yup. We limit our kids (2 under 10)to 2hr/day, though they need to “earn” that time by reading, and we give them a free hour each week.

We think that’s fair, and that’s our choice as parents. As they get older, we’ll give them more freedom to set their own rules.

If my local government made the same restrictions as I make, I would totally oppose it. I as a parent should decide what my house rules are.

It’s a pity that other languages weren’t voice acted. I understand it would probably be prohibitively expensive with a game like this.

    GyozaPower,

And probably not as high quality. The voice acting in thsi game is a 10/10. I doubt that, to put my own languages, it would be nearly as good in Spanish.

    Afrazzle,

I’ve ran into some conversations were some of the characters lines noticeably sound like they’re recorded from a different mic/in a different studio. Other than that it has been nice to have so much of the game voiced.
