“Nobody reads those EULAs, and the Defendant knows that. Therefore, the Defendant cannot hide behind the EULA as a shield because the Prosecution, having clicked Agree without being required to confirm that they read through the terms, could not have possibly known what they were agreeing to.”
“If you are what you agree to, your Honor, then my clients are an unknown spaghetti of legal mumbo jumbo.”
I would relish a lawsuit against EULAs where the defendant somehow sends the prosecutor a EULA in a software package that declares that they automatically lose the lawsuit by clicking Agree.
It would really hammer in the point that fucking NOBODY reads this shit.
I think someone calculated the time it would take to read every single one you’re expected to agree with in normal every day life, and it worked out to needing 76 work days to read everything you “agree” to in a typical year.
There was a video game store that once, for April Fools Day, included in its sale terms:
By placing an order via this Web site on the first day of the fourth month of the year 2010 Anno Domini, you agree to grant Us a non transferable option to claim, for now and for ever more, your immortal soul. Should We wish to exercise this option, you agree to surrender your immortal soul, and any claim you may have on it, within 5 (five) working days of receiving written notification from gamesation.co.uk or one of its duly authorized minions.
Only 12% of people that purchased that day responded, essentially confirming only 12% of people actually read the terms.
I think one could successfully argue in a court of law that people tend to be hyper aware on April 1st, and so may have read the terms suspecting something amiss when they otherwise would not have.
The judge would tell you you’re an idiot who said nothing worthwhile and that ignorance of the things you agree to doesn’t make them void when they’re used against you.
I first heard they were doing propaganda( to make them self look good in a positive light) by basically promoting in a show mythic quest, I’m guessing the creator of isaip is no saint either
When Ubisoft introduced always online DRM with AC2, I was out. It’s nice with the Internet how much being anti-Ubisoft has become common enough to be unsurprising
When the first Wreckfest(back then Next Car Game) launched as a crowdfunded game 12(?) years ago as an early access title it made sense. Flat Out as a franchise wasnt in their hands anymore and it hit rockbottom. So to develop a new game in a genre which had no competitor at the time with the community was compelling. Ngl the development was rocky at times. But in the end they made a super good game. THQ Nordiq got on board and with that funds for very big improvements in the tech it dearly needed. At times the game barely ran on high end PCs. But the engine got optimized so well it started to run well on the (now)last-gen consoles, then the switch and even mobile phones. But with that came also a lot of additions i really disliked. The physics got nerfed for the consoles but also on the PC, DLC galore, FOMO weekly events, the pretty realistic(ish) focus on folk racing shifted more into Flat Out 2 madness. The current game is very different to 1.0 . Not all for the better IMHO(!)
Either way: They again have a franchise with name recognition, they have a decently modern engine and game with lots of content to build upon and a publisher with funds. I dont see why an early access is needed? Especially in this super bare bones form with barely any cars or tracks(some even lifted from the last game) and nothing(!) else. I’ve put hundreds of hours into the last game. I still love it. Also i could really use finally a fresh new racing title after all the disappointments in the last years. But this… in this form isnt it. Especially knowing the community feedback might get thrown out in the future when the money man make decision. Meh
Like me! :) I've been having lots of fun with it. The AI is so much better and the car handling as well. Didn't realise till last night there's a massive collision like derby tucked away in one of the speedway modes. That was fun. Can't wait for more content to drop.
I do not expect to play games for a long time and I’m patient, so when I do want to play some game and it’s still in early access or is in active development (Like STALKER 2), I just put it off for later so that when I do finally play it, it’s a much better game/experience. This reminds me that it’s about time I finally try out cyberpunk (bought on day one, never launched)
It could be the sudden and unexpected success of Hollow Knight paralyzing them the way that happened with Valhiem. Not that it’s necessarily a fault of the devs; you hit a huge success like that, there is now a weight on your shoulder to always be that good.
This could be, hollow knight is one hell of a bar to clear. Valhiem was a lesson that studios are hard to scale up, and doing it distracts from development. There’s also something to be said about making a dream project, then having the focus and drive to keep it going and expanding.
Annd It’s possible their main dev might be addicted to balatro and there’s no way to factor or predict that kind of impact.
are they still working on it? yes? then it will come out when it comes out. There’s enough content in my backlog to keep me occupied for another 5 years at least, and more new games release every day. I can wait.
It is hard to make a sequel to the best game of all time, unless it is the new best game of all time. I’m not sure the extended dev time is the dominant issue here.
The lack of communication from Team Cherry is the only issue, and it’s the primary thing that makes me skeptical about the game ever releasing. If they were working on the game for this long, they’d at least have enough material to give us some kind of an update. It could be as small as a blog post.
Not to imply that they owe us that or anything. They possibly are just completely disinterested in marketing. It’s a little hard to believe given the amazing trailer that they put together years ago, but it’s still possible.
They do kinda owe people something - at least those that contributed to the funding of the first game. Silksong was originally a 2nd playable character that was unlocked as a reward from the Kickstarter for Hollow Knight. Then it turned into a DLC, and now it’s turned into a full game.
Idk if you’re being sarcastic but Hollow Knight is far from the best game of all time. Not saying it’s not good, but to crown it ahead of soooo many better games is pretty ridiculous.
And even if it were the best game of its genre, how can you compare it to other best games of all times like GTA SA or Mario Galaxy 2? They are totally different.
I mean… basically every platform is calling it an “upcoming game”. I want to say even fricking Nintendo have put it in a few sizzle reels?
Yes, it is a scientific fact that acknowledging Silksong adds at least another week until it releases. But it is also THE biggest indie game out there.
There’s a beta test branch on Steam that was uploaded 5 months ago, and the game has been age rated in South Korea. Yes, that game is coming. For good reason, it’s also the belle of the ball when it comes to marketing deals, so as much as it’s a meme to say maybe it’s at the next Nintendo Direct, it might be at the next Nintendo Direct. For everyone’s sake, I hope it gets its release date soon so that we can stop talking about it.
