donuts, do games w Nintendo Is Already Punishing Switch 2 Users Over Piracy ‘Suspicions’

Follow the link in the article to find out what really happened: www.reddit.com/r/NintendoSwitch2/…/my2iylo/

I also posted this in another threads a few days ago:

Nah, the OP of one reddit thread admitted he tried more than just his backups:

  • Dude is a prolific poster in Switch hacking communities and he used an account which he previously used with a hacked Switch 1
  • He admits trying the migswitch with the Switch 2 and it starting downloading something.
  • They got an online ban, so offline games and such still work.

You can agree or disagree whether piracy should be legal or whether backup copies are permitted (depends on jurisdiction), but this dude obviously played with fire and got burnt.

TL;DR: don’t be stupid and get banned for breaking ToS (whether you agree with it or not)

edit: more context: www.reddit.com/r/NintendoSwitch2/…/my2kigh/

MurrayL, (edited )

Sadly (at the time of writing) you’re just getting downvoted, because Lemmy’s hateboner for Nintendo is more important than context

donuts,

Yeah I was thinking the same, first few votes were down lol. Now you seem to catch the fire for pointing it out. Hope you care as much about votes as I do

Sophocles,

Things you should never get caught liking on Lemmy:
Nintendo
Windows
Auth-right, lib-right, or lib-left politics
A can of beans
Police
Man vs bear hypothetical
CalyxOS
Etc.

a can of beans

I’m pretty sure we like beans here. Unless you’re trying not to shit for 3 or more days.

fyzzlefry,

How dare you

Elevator7009,

I know Lemmy’s objection to most of these and I honestly dislike them too (oh no, brainwashed drone alert! Honestly, I consider myself quite lucky I hit a group where I actually do match the hivemind instead of being different yet again. Except I think Lemmy has a much higher tolerance for political posts, and for personal insults towards people who don’t share the hivemind than I do, but hey, you’ll probably never hit 100% consensus with any big group), except: I wasn’t aware that Lemmy had something against a can of beans. Genuinely, could someone please explain? Is this a reference to something, or is it genuine dislike towards canned beans? What’s wrong with canned beans?

Sophocles,

It’s a reference to this post. A lot of people found it funny but a lot of lemmings also thought it was insulting and spam

Elevator7009,

Thanks for the explanation!

I do not know the norms of shitpost communities, but as an outsider, I think it fits in perfectly.

Elevator7009, (edited )

Luckily at the moment they have a lot more upvotes than downvotes. Probably because they are providing information and aside from the “you are stupid for breaking (a likely-predictable) TOS and expecting nothing to happen” judgment, it’s pretty neutral on passing judgment on the bigger argument at hand: whether this policy should be here in the first place.

donuts,

If you see personal insults you should report the comment. Instances and communities have rules. Downvotes aren’t insults though

Elevator7009,

Oh yeah, I do report every time now, but I still see way too many.

Am aware downvotes are not insults and I don’t report downvotes, but also aware a lot of people use them as a plain disagree button.

katze,

They didn’t even get downvoted, but you decided to get angry about this imaginary scenario ojust in case. What’s wrong with you?

donuts,

I was sitting at like, -2 when they made that comment so not imaginary. Please try to give the benefit of the doubt before jumping to conclusions

katze,

I was sitting at like, -2

Oh no 😱

It’s funny that in lemmy vs reddit threads people always bring up that there is no karma farming, but then you see this nonsense.

donuts, (edited )

Stop moving the goalposts. Nobody cares about the votes themselves.

This is about observing a fact and recounting it to someone who’s misinformed about the situation and even has the audicity to gaslight someone over it

overload,

God this guy broke ToS while connected to the internet? Can’t MigSwitchs run offline? I thought it was just a cart dump.

Tbf, I hope nintendo keeps going this route and punishing more and more its customers. After all, if you keep supporting a company that hates you so much, you deserve what you get.

CluckN,

I don’t think Nintendbros will care. They already pay $120 to buy the same game twice.

SkunkWorkz,

Most of their customers don’t even know the Mig flash exists.

I’m a filthy Switch pirate and I only knew of the name. I didn’t know what it was exactly or how it worked until the recent reporting about it.

pory,
@pory@lemmy.world avatar

Well if you’re already a pirate you don’t need the MIG or benefit in any way from using it. Presumably you’ve got an Erista Switch or a modchip. The MIG is only for pirating stuff on modchipless Lite/Mariko/OLED/Apparently 2 (but watch out) consoles. It can’t pirate updates or DLC or eshop-only games so it’s always worse than CFW or modchips for those that can use CFW or modchips.

samus12345,
@samus12345@sh.itjust.works avatar

Yup, I have a modded Erista. Will update the firmware for Metroid Prime 4 and then I probably won’t be playing anything new after that on it.

Yes Nintendo yes! I’m sure you won’t turn into a Sony after the OtherOS debacle, just keep doin what you’re doing! LMAO

jonathan, do gaming w WotC DMCAs ‘Stardew Valley’ BG3 Mod, Despite Larian’s Endorsement

This TechDirt post is from yesterday, but the WotC issued a retraction last week. Great reporting?

PhilipTheBucket,

Yeah, I didn’t know about the retraction and it looks like Techdirt didn’t either. Oops.

Excel,
@Excel@beehaw.org avatar

The retraction doesn’t make it ok that they did it in the first place.

Huh? I thought they already retracted the DMCA and issued an apology.

What is this title? “mod to for map content” ?

Jayk0b, do games w Take-Two DMCAs Video Of GTA5 Mod To For GTA6 Map Content

Rockstar hates their community…

The GTA 4 to 5 port I can understand as they shipped original 4 music with the mid which is copyrighted.

thatKamGuy, do games w Take-Two DMCAs Video Of GTA5 Mod To For GTA6 Map Content

It’s a knee-jerk reaction, and it’s going to have a Streisand effect. I’m looking forward to the dozens of reposted videos spreading far and wide.

Ganbat, do games w Take-Two DMCAs Video Of GTA5 Mod To For GTA6 Map Content

Yeah, Take-Two clearly hates their player base. You’re supposed to give them money, and nothing else.

dota__2,

gaming has clearly angling towards skinner box design since mmos got big. you’re not a customer, just an atm to be looted for every penny.

They present Muse as a “generative AI model of a videogame” that you’d train to “learn about older games”. Which seems a very bold claim to begin with.

If this is anything like that, this is not a way to preserve the original game, it’s an attempt at reproducing (parts of?) it. And since generative AI is involved, there is no reason to believe it will be a faithful recreation.

Of course this could all be marketing bullshit, and for all we know their AI is just another coding assistant AI that they might use to create remakes. And then they’ll only be as faithful as the team making it can or will do it, as has always been the case with remakes.

    Anyway, remaking is not preserving.

Edit : was a bit slow trying to make my point, seeing now your edit. Yep, that’s exactly what I got from this too.

quickenparalysespunk, do games w No, Phil Spencer, Having AI Mock Up An Old Game Is Not The Same As Preserving It

i agree with the headline. strongly. didn’t read the article.

btw is tech dirt still funded by (one of) Koch bros?

edit: honestly, just checking. won’t complain, whatever the answer.

    sigmaklimgrindset,

According to their Wikipedia, Techdirt only accepted money from Charles Koch’s foundation for a lawsuit (amongst other donors), and are owned by Floor64.

Floor 64’s website only has 2 people listed in their management team, but I couldn’t dig up if either are linked to the Koch’s (I was pretty cursory about it though).

The article was worth a read for this quote alone:

VGHF library director Phil Salvador puts it even more simply: “Generative AI video is a great way to preserve video games, in the sense that mirages are a great source of water.”

BananaTrifleViolin, do games w No, Phil Spencer, Having AI Mock Up An Old Game Is Not The Same As Preserving It

One thing Phil Spencer does not seem to care about is emulation. There are already Xbox and PlayStation emulators that allow access to more of both platforms back catalogues than any of the current generation consoles are capable of…

Xbox could build cloud based emulators off the open source tools already available and make their entire Xbox back catalogue accessible to current users to stream. They could help improve the tools to ensure greater and greater compatibility for titles and then it would be there forever.

The reason it doesn’t happen is money. They dont see money in game preservation so they dont bother beyond a few big name nostalgia hits. Muse AI isn’t about game preservation, its about game development - they’re just pissing around with game preservation to feed it content as a punt on the future for it somehow making game development cheaper.

    pycorax,

I can’t say I buy this fully. From a marketkng standpoint, it seems like a huge win: “Subscribe to game pass ultimate and you get thousands of games old and new, up by thousands from last year”. From a financial standpoint, running those emulators should be a lot less compute heavy than current games so it should be cheaper.

The only real issue I see here is legal. Licensing the rights to distribute the games via streaming for their entire back catalogue can’t be easy.
