At first I was like “WTF does an indie games site have to do with Funko?” then I Googled it…

Looks like they hosted a BUNCH of infringing games, so Funko, instead of doing the righteous thing and sending them a takedown request, just nuked the whole domain…

I mean, I don’t blame them for protecting their IP, they just picked a super shitty way to do it.

I don’t even think they would have needed an official cease and desist… just a friendly note of “Hey, none of this Funko material is licensed, please remove it.”

jordanlund,
@jordanlund@lemmy.world avatar

It’s not fair use to use images and names you have not licensed.

Well, if you care about an indie gaming site being shut down for copyright violations, yeah, you might want to actually care about copyright infringement.

What they were doing here though was supporting developers profiting off someone elses IP. It would be like, I dunno, I started an independent Superman movie and was fundraising off that. It’s a little different from piracy.

In the case of the Five Nights at Freddies game, the developer is infringing on not one but TWO properties.

jordanlund,
@jordanlund@lemmy.world avatar

No, it isn’t.

copyright.psu.edu/copyright-basics/fair-use/

“In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—

the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

the nature of the copyrighted work;

the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

the effect of the use upon the potential market for or value of the copyrighted work.”

So, me, making a fan page for FunkoPop versions of the Five Nights at Freddies characters and using their images? THAT’S fair use.

Me charging money for a fan game based on the same Funko versions of those characters is NOT fair use.

“Section 107 of the Copyright Act gives examples of purposes that are favored by fair use: “criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, [and] research.””

jordanlund,
@jordanlund@lemmy.world avatar

Hence the “super shitty way to do it”. ;)

jordanlund,
@jordanlund@lemmy.world avatar

Fortunately our laws aren’t about what’s moral or not. You need religious police for that.

The correct process would have been to issue a takedown request, then go after the domain if nothing was done, they just jumped the gun.

I find the same thing, but I’m really questioning the taste of others.

Never really did PC gaming, bought a SteamDeck to get into that ecosystem after seeing all the posts about “ZOMG! STEAM SALE!!!”

Are people just… not discerning? Do you just buy ANYTHING because it’s on sale?

The signal to noise ratio on Steam is just nuts to me… Yeah, some game might be $1.99, 90% off, but if it’s not worth the bandwidth to download, why are you bothering? Do you lack the ability to tell good games from bad games?

jordanlund,
@jordanlund@lemmy.world avatar

And then there’s…

82% Positive? Are you shitting me?

Why are $70 AAA games slashing prices so drastically? (lemmy.world) angielski

It’s beyond insane to me that a $70 “AAAA” game (kidding, it’s AAA) dips down to the absurd price of $5. I’ve never seen anything like it. Wish the entire Sims 4 “collection” if you can call it that was $5 total, would be incredible, or Starfield.

jordanlund,
@jordanlund@lemmy.world avatar

Because it’s two years old?

jordanlund,
@jordanlund@lemmy.world avatar

If it were just the Autumn sale, stuff like Space Marines II would have a steeper discount and frankly that sale is more than a little aenemic.

jordanlund,
@jordanlund@lemmy.world avatar

Oh, shit, there’s a sale?

store.steampowered.com

Hmmm… old games I already own, games I won’t bother downloading…

Epic Mickey Rebrushed for $30 isn’t bad.
Space Marines II for $47.99 needs a bigger discount…

If your primary gripe is combat, you need to understand it’s not a combat game. It’s an exploration/survival game.

Origins was such a boring game. Hackneyed, utterly predictible plot, graphics that looked like the previous generation. There wasn’t really much there to like, and then the next games were worse.

Not sure how we even got as far as Veilguard…

jordanlund,
@jordanlund@lemmy.world avatar

I think there’s not a lot of room for competition, it’s either Gran Turismo on PS5, Forza on Xbox or… um… Mario Kart? On Switch?

You could say the same thing about Football games. There’s Madden and NCAA and that’s pretty much it.

The era of having niche games like Metropolis Street Racer, Project Gotham, Speed Devils, or, heck, go back to the OG Playstation with Wipeout, Jet Moto, Destruction Derby… that’s long over.

Which is a shame because I played the HELL out of MSR/PGR.

Absolutely. It’s a matter of artistic expression.

    Destiny is a little different because the vaulting was done by Bungie, not by steam.

    I need some suggestions on what to play. Single Player games only. Most of the games make me feel lonely and alone. Not sure where you’re seeing $60. PC Digital purchase through Gamestop is $40.

    But this is a problem with digital stores vs. physical.

    It’s not quite the same thing… Mid generation refreshes are, generally, due to changes in technology outside of gaming.

    Look at the first mid-gen refresh… The Sega CD and NEC Turbo CD for TurboGrafx (released as a separate machine called the Turbo Duo).

    CD technology changed gaming, but the console makers at the time weren’t ready yet for a new generation.

    Sega and NEC refreshed the current gen with CD technology, Nintendo explored it with Sony, and abandoned it (as Nintendo is generally always a generation behind), which led directly to the Playstation a few years later.

    We saw it again in the Xbox 360/PS3 era. Those machines launched in 2005/2006. A global financial crisis took all the air out of the room and made financing R&D for a next generation impossible just when it needed to start ramping up in 2008/2009.

    So what Microsoft and Sony did was pivot to try to enter the casual market that the Wii dominated by releasing Kinect and Move respectively in 2010, when a new console SHOULD have launched but did not.

    The next true generation was still 3 years away at that point, but Kinect and Move let them limp along until they got there.

    The same thing happened with the Xbox One and PS4, television technology greatly advanced after they launched in 2013 and it became apparent that all these 4K television owners were looking for 4K content.

    Nobody was prepared to launch a new console, so we got the Xbox One S without 4K gaming, but with a 4K Blu Ray drive, the PS4 Pro, which had no 4K drive, but kinda, sorta on a good day, could almost do 4K gaming, and the Xbox One X which ran 4K games, 4K movies, and massively upgraded older non-4K games.

    For the PS5 Pro? There is nothing demanding the refresh. Sony says they’re doing it because players want better frame rates, but those 3/4 of players choosing performance mode are already showing they don’t care about fidelity.

    Moreover, the latest thinking is that for GTA6, the promise of increased frame rate STILL won’t be a reality.

    rockstarintel.com/gta-6-60-fps-ps5-pro-struggle/

    So what’s the point?

    With the release of “The Final Shape,” the main storyline has concluded, and it seems like the developers are now just churning out random content and seasonal passes without a clear direction for the game’s future. Goes for Raid design too…

    Take a group of 6, split into three groups of two.

    A, B, and C.

    A go to the right, B go to the left, C stay in the center.

    Do the thing, then rotate, A to B, B to C, C to A.

    Do it again. Rotate again. Do it again. Rotate again.

    Damage phase. Repeat until someone screws up and you all die or boss is dead.
